Waiting until you are already under contract can turn a routine document request into a last-minute scramble involving the association, managing agent, seller, escrow and other transaction professionals.

Buyers may want to examine information involving the condominium’s governing documents, current budget and financial condition, reserve information, insurance, recent meeting minutes, special assessments, planned capital projects and other association matters. The goal is not simply to create a folder of paperwork. It is to understand the story of the building before the buyer does.
Is there an upcoming assessment? An insurance concern? A reserve issue? A major project? An unusual rule that could affect a prospective buyer? Discovering these matters early gives a seller and listing broker time to understand them and market the property accurately.
One important distinction: Hawaiʻi law establishes specific seller disclosure requirements for residential property subject to a recorded declaration, while additional condominium documents may arise from the purchase contract, association-record provisions and the buyer’s own due diligence. Not every item commonly reviewed in a condominium transaction is part of one statutory checklist.
This preparation can be particularly valuable for owners living on the U.S. mainland or overseas who are selling Hawaiʻi property remotely.
