Hawai‘i Beachfront Homes: Is a “Private Beach” Really Private?

That phrase — “private beach” — can sound like the ultimate Hawai‘i luxury. It can also create the wrong expectation.

In Hawai‘i, oceanfront ownership, shoreline access and beach access are not necessarily the same thing. So when a property is marketed with “private beach” language, a smart buyer should slow down and ask exactly what is private: the access path, a gate, a beach club, a recorded easement — or something else.

In this video, I explain the questions buyers, sellers, investors and relocation clients should ask before relying on beachfront marketing language:

• Is the beach access deeded and recorded?
• Is there a public right-of-way or private easement?
• Where is the applicable legal shoreline?
• Does the property have direct access or simply proximity to the coast?
• Are erosion, flooding, setback or shoreline-management issues involved?
• What access rights actually transfer with the property?

A secluded stretch of Hawai‘i coastline may feel private while the underlying legal rights can be quite different from the marketing impression.

And there is a timely 2026 consideration. Hawai‘i recently established a regional shoreline-adaptation planning framework that places continued emphasis on public beaches and lateral shoreline access. For coastal buyers, the larger lesson is simple: due diligence increasingly extends far beyond the ocean view.

Shoreline location. Access. Easements. Title. Flood exposure. Erosion. Permits. Resilience. Future adaptation.

Those details can matter enormously when evaluating Hawai‘i oceanfront real estate.
