Selling a Home in Hawaii? What You MUST Disclose (Or Face Lawsuits!) ⚠️🌴

Thinking about selling your Hawaii home but conveniently forgetting to mention that roof leak from 2018? Stop right there. Today, we are spilling the tea on Hawaii’s strict disclosure laws and what happens if a seller tries to be “sneaky.”

In Hawaii, Chapter 508D is the law of the land. It requires sellers to disclose any “Material Fact”—meaning any past or present defect or condition that would measurably affect the property’s value to a reasonable person. Whether it’s past termite damage or a neighbor’s pipe that leaked through your ceiling, you must document it on the Seller’s Real Property Disclosure Statement (SRPDS).

What happens if you hide an issue? A buyer can legally rescind the contract and walk away with their deposit. Worse, if they discover the hidden defect after closing, they can take you to court for damages, repairs, or even force an unwinding of the entire sale.
